Welcome to RSRVD Pickleball. These Terms of Service ("Terms") govern your access to and use of the website located at https://www.rsrvdpickleball.com and any related content, features, products, services, and tools we make available through the site (collectively, the "Services").
Throughout these Terms, "RSRVD Pickleball," "we," "us," and "our" refer to RSRVD Pickleball Co LLC, doing business as RSRVD Pickleball.
By accessing, browsing, or using the Services, or by purchasing from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
1. Eligibility and Account Use
You must be at least the age of majority in your state or province of residence to use the Services or place an order. If you use the Services on behalf of a minor, you represent that you are the minor's parent or legal guardian and that you accept these Terms on their behalf.
You may be asked to provide information such as your name, email address, billing address, shipping address, and payment details. You agree that all information you provide is accurate, current, and complete, and that you have the legal right to use any payment method you provide.
You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person without our prior written consent.
2. Products and Product Information
We make reasonable efforts to describe and display our products accurately. However, product colors, textures, and appearance may vary based on your screen, device settings, lighting, and manufacturing differences.
We reserve the right to update product descriptions, pricing, availability, sizing information, and other product details at any time without notice. We may discontinue products or limit quantities available for purchase.
Nothing on the Services constitutes a guarantee that a product will look exactly the same in person as it appears on your screen.
3. Orders and Acceptance
Placing an order is an offer to purchase. Orders are not accepted until we review the order and send an order confirmation or shipment confirmation. We reserve the right to refuse, limit, cancel, or modify any order at our sole discretion, including in cases involving suspected fraud, pricing or inventory errors, resale activity, or shipping restrictions.
If we cancel or materially modify an order after payment has been authorized, we will attempt to notify you using the contact information provided and issue any required refund to the original payment method.
Please review your order carefully before submitting it. Once an order is placed, we may not be able to change or cancel it.
4. Pricing, Promotions, and Billing
All prices shown on the Services are listed in U.S. dollars unless otherwise stated. Prices, discounts, and promotions may change without notice.
Unless expressly stated otherwise, posted prices do not include applicable taxes, shipping charges, customs duties, import fees, or similar charges. These amounts, if applicable, will be shown at checkout or are your responsibility upon delivery.
You agree to provide current, complete, and accurate billing and payment information for all orders. By submitting payment information, you represent and warrant that:
- you are authorized to use the payment method provided;
- the information submitted is accurate and complete; and
- you authorize us to charge the full amount of your order, including shipping, taxes, and any other disclosed charges.
Promotions may be subject to separate terms. If there is a conflict between a promotion's terms and these Terms, the promotion terms will control for that promotion.
5. Shipping, Delivery, and Risk of Loss
We ship to locations listed at checkout. Shipping times are estimates only and are not guaranteed. Delays may occur because of carriers, weather, customs, high order volume, or events outside our control.
Title to and risk of loss for products pass to you upon delivery of the products to the shipping carrier, to the extent permitted by applicable law.

6. Returns, Refunds, and Exchanges
Returns, refunds, and exchanges are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.
If your order arrives damaged, defective, or incorrect, please contact us promptly at hello@rsrvdpickleball.com and include your order number and supporting details or photos where applicable.
7. Intellectual Property
The Services, including our website design, text, graphics, logos, icons, images, videos, product photography, product descriptions, trademarks, service marks, and other content, are owned by or licensed to RSRVD Pickleball and are protected by applicable intellectual property laws.
These Terms grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, or exploit any part of the Services without our prior written permission.
All rights not expressly granted are reserved.
8. Optional Tools and Third-Party Services
We may provide access to tools, features, integrations, or services offered by third parties. We do not control these third-party services and are not responsible for their availability, content, accuracy, or performance.
Your use of third-party tools or services is at your own risk and may be subject to the third party's own terms and policies.
9. Third-Party Links
The Services may contain links to third-party websites or resources. We are not responsible for the content, policies, products, or services of any third-party website. Accessing third-party websites is at your own risk.
10. Shopify Platform
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products and services to you. However, all purchases made through our store are transactions between you and RSRVD Pickleball, not between you and Shopify.
To the fullest extent permitted by law, Shopify is not responsible for claims arising from your purchases from us.
11. Privacy
Your submission of personal information through the Services is governed by our Privacy Policy. Because our store is hosted on Shopify, Shopify may also process certain data as described in Shopify's policies.
By using the Services, you acknowledge that you have reviewed our Privacy Policy.
12. User Content, Feedback, and Reviews
If you submit reviews, comments, feedback, suggestions, testimonials, photos, videos, or other content to us or through the Services (collectively, "User Content"), you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, publish, display, adapt, modify, distribute, and otherwise use that User Content in connection with our business, marketing, and operation of the Services.
You represent and warrant that:
- you own or control all rights necessary to submit the User Content;
- your User Content is accurate and not misleading;
- your User Content does not violate any law or any third party's rights; and
- if you received free product, discounts, payment, or any other incentive related to the User Content, you have disclosed that fact where required by law.
We may, but are not obligated to, monitor, remove, edit, or reject User Content in our sole discretion.
13. Accuracy of Information
Occasionally, the Services may contain typographical errors, inaccuracies, or omissions related to pricing, product descriptions, promotions, shipping estimates, transit times, or availability. We reserve the right to correct such errors and to update information or cancel orders if information is inaccurate, including after an order has been submitted.
14. Prohibited Uses
You may not use the Services:
- for any unlawful purpose;
- to violate any applicable law or regulation;
- to infringe our intellectual property rights or the rights of others;
- to submit false, deceptive, or misleading information;
- to upload or transmit malware, malicious code, or harmful content;
- to scrape, crawl, spider, copy, mirror, or data mine the Services without our written permission;
- to interfere with or bypass the security or operation of the Services; or
- to harass, abuse, threaten, or harm us, our customers, or any other person.
We may suspend or terminate access to the Services if we believe you have violated these Terms.
15. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.
Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.
16. Disclaimer of Warranties
To the fullest extent permitted by law, the Services and all products and content made available through the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any content on the Services will be accurate or complete.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
17. Limitation of Liability
To the fullest extent permitted by law, RSRVD Pickleball and its officers, directors, employees, contractors, affiliates, service providers, licensors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, data, goodwill, or business interruption, arising out of or related to your use of, or inability to use, the Services or products purchased through the Services.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services or any product purchased through the Services will not exceed the amount you paid to us for the product or service giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
18. Indemnification
You agree to defend, indemnify, and hold harmless RSRVD Pickleball and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
19. Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
20. Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
21. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policies posted on the Services, constitute the entire agreement between you and us regarding the Services and supersede prior agreements or communications relating to the Services.
22. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction.
23. Governing Law
These Terms and any dispute between you and RSRVD Pickleball relating to the Services will be governed by the laws of the State of Oregon, without regard to conflict of laws principles.
To the extent permitted by law, any legal action arising out of or relating to these Terms or the Services must be brought in the state or federal courts located in Lane County, Oregon or the nearest appropriate court with jurisdiction, and each party consents to that venue and jurisdiction.
24. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and update the Effective Date above. Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.
